In March of 2023, AFGE Local 2063, representing employees at the Raymond G. Murphy VAMC in Albuquerque, New Mexico and surrounding clinics, filed a grievance against the VA on behalf of all its bargaining unit employees. The Grievance alleged violations of the Fair Labor Standards Act (FLSA) and Title V (FEPA), among other violations.

The Law Offices of Snider and Associates and the Pines Federal Employment Attorneys (www.pinesfederal.com), as the legal representatives for the Union, are working hard for the bargaining unit employees to ensure that their rights under federal law are upheld. As part of the process, we have been contacting VA employees about their job duties and how much unpaid overtime they have worked.

The matter has proceeded to arbitration, with Arbitrator Stanley Michelstetter presiding. Hearings began in July of 2024, and are continuing into 2025. The subjects of the hearings include testimony from bargaining unit employees who were not properly compensated for overtime.

All Title 5 and Title 38 hybrid bargaining unit employees, whether or not they are members of the union, and regardless of position or pay grade, may be covered by this grievance and could potentially benefit from a successful result.
