Age Discrimination Lawyer
Do you believe that you’re being discriminated against at work because of your age? Reach out to an age discrimination attorney to file an official claim and work to hold your employer accountable for their actions.
When you’re older than most of the other employees you work with, being treated differently because of your age can feel terrible. Your employer should never pre-judge you based on age but should critique you based on your performance instead. Sometimes, your age may be the underlying reason you’re let go or you never get hired in the first place. This treatment is considered age discrimination.
At Snider & Associates, LLC, our goal is to help potential, current, or previous employees stand up against the mistreatment they’ve experienced. The Age Discrimination in Employment Act (ADEA) protects federal employees over the age of forty from being discriminated against based on age.
An age discrimination lawyer from our team can help you file a claim with the Equal Opportunity Employment Commission (EEOC) if you feel your employer has somehow discriminated against you. Your rights are important to us, and we want to help you get the respect you deserve.
Components of the Age Discrimination in Employment Act
The ADEA only protects employees from age discrimination in the workplace who are forty years of age or older. Whether the discrimination comes in the hiring process, through a lack of promotion, in the form of firing, in a compensation-related matter, by harassment, or some other means, the mistreated employee can report the incident and take action to hold the employer accountable for their actions.
Examples of Age Discrimination in the Workplace
If the employer or another employee harasses an individual who’s over the age of forty by making age-related jokes or offensive remarks, then age discrimination is occurring. Similarly, if a company refuses to hire or promote someone because they’re over the age of forty, then this would be unlawful behavior under the ADEA.
Those who are over the age of forty must follow the standards of the ADEA, as well. They can’t harass others in the workplace older than themselves or of the same age.
Filing a Claim for Age Discrimination with the EEOC
If you believe you’ve suffered age discrimination of any kind while at work, you can file an official claim with the EEOC online or at your local EEOC office. When filing a claim in person, you’ll get interviewed by an EEOC staff member, and they’ll carefully document your information.
Once you file an official claim, the EEOC will typically suggest that you go to mediation to resolve the issue with your employer. If mediation doesn’t resolve the issue, then the EEOC will investigate whether discrimination has taken place. If you don’t agree with the EEOC’s decision, you can request a notice for a right to sue and take your employer to court.
