The statistics for the Merit Systems Protection Board Washington Field office have been released, and as it has been in the past, the results are not promising for Appellant Employees. Out of 914 appeals filed in FY 2011, the Washington Field Office issued only 13 decisions in favor of employees a miniscule 1.4%. Further, four AJs failed to issue a single decision in favor of an employee. Additionally, 25% of cases settled.
We all know that MSPB statistics are very much pro-Agency – However, these statistics let you know just how true that really is. In our experience, however, clients that have reasonable settlement expectations can often receive somewhat favorable settlements that include, among other relief, the ability to continue their federal employment elsewhere.
